NY Prosecutor's case against Donald J. Trump is a violation of the NY State Constitution.

https://www.nationalreview.com/2024/04/braggs-prosecution-of-trump-violates-new-york-states-constitution/?bypass_key=QW4wcVFKQ2hWbGtFb3Vqc2lNZDUxQT09OjpWV3RrTkRKd0szQnVhRTQwYzFsQ1ZuWkdaSGhJUVQwOQ%3D%3D

" Once one clears away the e******n-theft and federal-law underbrush, Trump is actually charged not with a conspiracy but with 34 substantive felony violations of a New York statute that makes it a crime to falsify business records with the fraudulent intent to conceal “another crime.”

" What other crime? The penal statute in question doesn’t say. That’s a fatal problem because New York State’s constitution mandates that a statute must spell out any statutory terms it is incorporating. Under Article III, §16, of the state constitution, incorporation by reference is not permitted. "

It appears under Govenor Hochel the DAs have Carte Blanche to proceed as they choose with the bias chosen judges - she is a f**e but the fault for all the problems NY is facing lyes with the v**ers that put them in the positiins they hold - Trump will win any and all created inditements on appeal for any that Democrat prejudice jury’s find but the v**ers and that includes the juries are stuck with what they put in office - what’s sad these v**ers don’t know any better and do not know the meaning of living in a state that doesn’t tread on their constitutional rights as citizens

100% correct but with a crooked judge who has the lead, Trump will continue to be sandbagged and they will continue to lawfare him. That is the game. Try to bankrupt him whether they win or lose the trial. Criminal what they are doing to this great President Trump.

Why can't Donald J. Trump sue for malicious prosecution and ask for $ Billions ?

This isn't my practice area but from what I can remember is at least in NYS a DA, AG, Judge can't be civilly sued. Probably all states. The police, FBI can possibly be sued for false arrest etc and a civil judgement may be rendered. Trump may even be entitled to proceed civilly on additional federal charges against the DA, AG, Judge for his Civil Rights violations, e******n i**********e as well as other charges, state or federal for civil litigation.
That being said, if there was a criminal element where intent can be proven that the DA, AG, Judge did act with criminal intent, which in my opinion they are, not even following procedural rules/laws it seems, can be charged with crimes and possibly held personally for damages. Once convicted in criminal court a civil suit usually would follow. Civil suits that are followed by criminal convictions are stronger. But please don't hold me to the finer points.
Also the NYS Bar is very dem politically so depends but at the very least they also could be censured or disbarred depending on the outcome of a criminal or ethics violations, which would be a good thing for society.
